IT外包的投资、再谈判机制分析

本文从IT承包商(vendor)和客户(client)的角度考虑去设计最优契约。由于客户方的需要,或者是由于契约的不完全性导致契约经常需要再谈判,而且由于契约修改后的执行问题也可能引起法律诉讼,因此对于如何决定事前的投资、谈判利润分配和契约诉讼的赔偿都是一系列要解决的问题,本文正是根据这些问题的提出而逐步展开的。

唯物主义理论有着不同的理论形式和形态,这些理论形态或形式随着人类的实践的深入而不断改变。近代工业革命以来,唯物主义建立在牛顿力学的基础上,将自然看作机械的,以开发自然、征服自然为旗帜。但工业革命所带来的环境问题、生态问题在现代则越来越困扰、甚至威胁着人类的生存。唯物主义就必须改变它的内容与形态,以自然之子的态度定位人与物质宇宙的关系,崇仰宇宙、敬畏宇宙,不是从纯粹知的形式,而且也从爱的、情智的关系上理解唯物主义的内涵与唯物主义的新形式。     

关于旅游合同示范文本的法律思考

旅游合同示范文本由旅游局和工商局联合制定推广,性质上属行政指导,具有效率、安全、优先及补充等法律价值,示范文本条款分四大功能模块,由通用条款和协议条款组成。目前示范文本是多级制定,种类单一,权威性不高,文章提出完善和丰富示范文本种类和内容、统一示范文本和示范文本备案豁免等建议,以提升旅行社使用示范文本的积极性,发挥示范文本的作用。     

孟加拉合同效力法律规制述评

由于高度移植印度《合同法》,孟加拉《合同法》在效力方面的规定与大陆法系和英美法系合同立法原则有不少不同之处,尤其是对于要约和承诺的生效原则、未成年人签署合同的效力问题,均有实质差异。同时,对于条件合同和无效合同,孟加拉《合同法》虽然和我国一样秉承意思自治原则为主导,但对于所附条件的形式和实质内容以及合同无效之规定却颇有迥异。     

IT运维外包中外派人员组织归属感的影响因素研究——基于心理契约理论的多案例研究

现在越来越多的客户将其部分或全部的IT运维工作交给外部的专业服务提供商。IT外派人员长期在客户的现场提供服务,这也导致了外派人员对母公司缺乏组织归属感。本文选择了四个涉及IT外派人员的IT运维外包项目进行案例研究,试图探寻影响外派人员对母公司组织归属感的影响因素。本文发现影响外派人员组织归属感的因素主要包括沟通、公平、员工关怀和稳定预期,但是在不同的心理契约情境下影响外派人员组织归属感的因素各不相同。     

The role of talent-perception incongruence in effective talent management

This study examines the effect of talent management (TM) practices, differentiation strategies, and incongruent talent perceptions in terms of psychological-contract fulfillment. The outcomes of the quantitative analysis of 2660 respondents within 21 organizations show the importance of actively attending to talent-perception incongruence. Incongruence occurs in situations where the organization's executives perceive an individual as ‘talent’, but the individual is unaware of this, and also the other way around: the situation in which the organization's executives do not consider an individual as ‘talent’ while the individual believes that they do. Although the increased use of TM practices is related to higher psychological-contract fulfillment, this relationship is negatively affected by incongruent talent perceptions. Our results show the importance of clearly defining talent and communicating this clearly to all employees. This is particularly important when the talent strategy is perceived as exclusive rather than inclusive.     

The Rise and Decline of Small‐Scale Sugarcane Production in South Africa: A Historical Perspective

South Africa's sugar industry has long been distinguished by its large number of small‐scale sugarcane growers (SSGs) farming on ‘communal’ land and its peculiar privately administered regulatory structure. In recent years, however, the numbers of small‐scale growers have declined precipitously. This paper argues that the relationship between the rise and fall of SSG production and the industry's governing regulatory structure is closer than usually appreciated. The emergence of SSG production in the late 1970s and the 1980s can be traced to industry‐subsidized initiatives, disguised as small‐scale credit, to bring commercially inalienable Bantustan land into cane production with strong miller oversight. From the late 1980s to 1990s, however, the elimination of these subsidies encouraged millers to subcontract support to farmers, while simultaneously instigating an increase in SSG numbers by removing restrictions on grower registration. Although low rainfall is a central proximal factor in the rapid decline of the SSGs in the 2000s, their rapid increase was structurally fragile.     

Marginal Economy: Growth Strategies for Post-Growth Societies

A sharp problem focus sharpens the problem. Sustainably growing bodies of literature on degrowth are not the key to post-growth scenarios because evocations of the limits of growth reinforce rather than transcend the economic principle, which is in the observation of scarcity. Therefore, I focus on alternative forms of growth rather than alternatives to growth. My form-theoretical analysis of growth dismoralizes growth and disembeds it from the economic medium in which it is preferably drawn. I suggest that the key to a post-growth society is in a regrowth of interest in growth in, so far, neglected non-economic function systems.
